Apple wins patent battle against Samsung in Germany

In the first ruling one of Samsung’s patent-infringement claims against Apple in Germany, Mannheim Regional Court judge Andreas Voss gave the verdict in favor of Apple.

Despite the fact that the full-detailed written ruling is yet to be made available officially, Judge Voss reported dismissed Samsung’s claims which involved EP 1,005,726; a patent which chiefly pertains to the 3G/UMTS wireless telecommunications standard.

With the patent in question largely covering turbo encoding and decoding device and also mechanism for process frame data in accordance with quality-of-service, it essentially related to turbo channel encoding/decoding device for a CDMA communication system.

Despite the fact that the patent claim will likely have no immediate effect on either Apple or Samsung, the latter still has the option of appealing against the verdict to the Higher Regional Court in Karlsruhe.

Expressing disappointment with the verdict and saying that the ruling relates to “only one of several patents asserted by Samsung in the Mannheim court,” Samsung said that it would come to a decision about whether or not it should appeal to the Higher Regional Court only after it has received further details about why the Mannheim Court had rejected its patent claim.

Adding that Voss’ verdict relates to “only one of several patents asserted by Samsung in the Mannheim court,” Samsung said that the ruling “is of no indicative value as to whether Apple may be found to infringe other of Samsung's intellectual property rights in Germany.”
