Apple wins patent battle against Samsung in Germany

In the first ruling one of Samsung’s patent-infringement claims against Apple in Germany, Mannheim Regional Court judge Andreas Voss gave the verdict in favor of Apple.

Despite the fact that the full-detailed written ruling is yet to be made available officially, Judge Voss reported dismissed Samsung’s claims which involved EP 1,005,726; a patent which chiefly pertains to the 3G/UMTS wireless telecommunications standard.

South Korean electronic giant Samsung may soon be allowed to sell its redesigned Galaxy Tab tablet in the, thanks to a German court's preliminary ruling that the redesigned tablet is not a copycat version of Apple's iPad.

Previously, the German court had ruled in favor of Apple, forcing the South Korean manufacturer to modify its Galaxy Tab 10.1 and name it Galaxy Tab 10.1N.

But, the Cupertino, Calif.-based gadget maker challenged even the redesigned version of the Galaxy Tab and requested the court for an injunction on the distribution of the devise in Germany.

Samsung’s Galaxy Tablet Can be Sold in Germany

Another revelation on the matter of prohibition imposed on Samsung on selling and promotion of the Galaxy Tab 10.1 tablet in Germany, takes away all the reasons from Apple to rejoice.

As per the ruling of the court, the ban has been imposed only on the Samsung store and not on the other electronic device selling stores. The product has not been prohibited to be sold in Germany, by the manufacturing company Samsung.

Samsung Stops Displaying New Tablet at IFA

Samsung Electronics, the South Korean IT giant has, reportedly, received an order from the German court to put a stop on the display of the company’s new product i. e. the tablet computer at IFA Berlin, Europe's largest electronics show.

And, to comply with a Düsseldorf court's decision, the company decided to suspend all the sales of its new Galaxy Tab 7.7. Moreover, Samsung also put a stop on the display of its new tablet at last week’s IFA trade show in Berlin as per order from the court.

Samsung 7.7 inch Galaxy Tab was pushed out of trade fair of Germany, on Saturday, due to the wrangle it has been facing by the giant Apple.

Apple has won the court ban over the Galaxy Tab which led Samsung to remove its gadget from the IFA technology conference in Berlin.

The Samsung Blog had notified that the company had already exhibited a label stating "Not for Sale in Germany". Samsung has also detached an online video which included a launch section for the promotion of the device.

The blog stated, "It's as if the tablet never happened".

Samsung’s iPad Outlawed in Germany

On Tuesday, the Dusseldorf Regional Court has announced that the ban over Samsung’s Galaxy Tab 10.1 will remain till Germany only and won’t be enforced throughout the whole Europe.

Court Spokesman Peter Schuetz informed, “The judges decided to limit the enforceability for now because there are doubts whether a German court has so a wide a jurisdiction over a company based in Korea”.

The ban was enforced over the tablet following the legal battle between Apple and Samsung.
